On March 28, 2024, the Hospital Transparency Act came into force, which obliges hospitals in Germany to disclose extensive internal structural and performance data. The aim of this legal regulation is to improve the quality and comparability of inpatient treatment. The data collected flows into a public transparency directory that provides patients and referring doctors with detailed information about hospital locations and the services they offer.
New legal requirements for hospitals
Under the Hospital Transparency Act, hospitals are now obliged to submit the following data on a quarterly basis:
- Levels of care: Hospitals are assigned to a specific level of care in order to clearly show their performance and specialization.
- Service groups: The medical services provided must be differentiated according to service groups.
- Staffing: In addition to the medical staff structure, hospitals must provide detailed information on staffing in other areas.
- Quality indicators: Certain quality aspects, such as treatment results and patient satisfaction, must be documented on a mandatory basis.
A key component of this regulation is the precise recording of non-patient activities in the medical service. Hospitals must specify the medical staff in average full-time equivalents (FTEs) per quarter for each specialist department and distinguish between “direct patient care” and other activities. This includes, among other things:
- External training and further education
- Quality assurance
- Statutory tasks such as occupational health and safety, hygiene or pandemic officers
